By booking a MED-Spanish Immersion On-line/On-site experience, attendees consent to release PACE MD, MED-Spanish, PACEMD MEXICO A.C.'s, GEMS LLC or the "Site” and/or its agents, from any liability related to the faults or defaults of proper services or services from other companies and persons that may be used in the carrying out of teaching, clinical rotations and/or any other related experiences or services. PACE MD, MED-Spanish, PACEMD MEXICO A.C.'s, GEMS LLC or the "Site” and/or its agents, strongly recommend you take your time to plan ahead and double check with your corresponding authority; board(s), university dean(s), association(s), area director(s) and/or coordinator(s) to authorize this experience before actually committing to the trip to avoid any inconveniences during the CME acceptance and subsequent processing misunderstandings.
The foretold liabilities include and are not limited to: Accidents, baggage losses, delays, or cancellations; force majeure such as strikes, political unrest, riots and acts of God and war; and change in airline schedules in the event it becomes necessary or advisable for the comfort and well-being of passengers, or for any reason whatsoever, to alter any itinerary or arrangements, as such alterations may be made without direct penalty or penalty to the operator(s).
Additional expenses, if any, shall be borne by the students/mid-levels/professionals.
The right is reserved to withdraw the On-line/On-site experiences due to insufficient participation or for any reason whatsoever; also, to decline to accept or to retain any person as members of the experiences. The airlines, shuttle, transportation and/or bus lines concerned are not to be held responsible for any acts, omissions, or events during the time the passengers are not on board. The passage contract in use by the airlines or transport companies concerned constitutes the sole contract between the company and purchase of this experience and/or passengers.
The issuance and acceptance of invoices and/or receipts and/or coupons, along with making the initial deposit, shall be deemed to be consent to and acceptance of the foregoing terms and conditions.
WAIVER AND RELEASE OF LIABILITY:
By booking a MED-Spanish Immersion On-line/On-site experience, (the "Activity"), attendees consent to the following: In consideration of the risk of injury while participating in the Activity, and as consideration for the right to participate in the Activity, I hereby, for myself, my heirs, executors, administrators, assigns, or personal representatives, knowingly and voluntarily enter into this waiver and release of liability and hereby waive any and all rights, claims or causes of action of any kind whatsoever arising out of my participation in the Activity, and do hereby release and forever discharge PACE MD, MED-Spanish, PACEMD MEXICO A.C.'s, GEMS LLC or the "Site” and/or its agents, located at Guanajuato, Mexico, their affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors and assigns, for any physical or psychological injury, including but not limited to illness, paralysis, death, damages, economical or emotional loss, that I may suffer as a direct result of my participation in the aforementioned Activity, including traveling to and from an event related to this Activity. I am voluntarily participating in the aforementioned activity and I am participating in the activity entirely at my own risk. I am aware of the risks associated with traveling to and from as well as participating in this activity, which may include, but are not limited to, physical or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability (including paralysis), economic or emotional loss, and death. I understand that these injuries or outcomes may arise from my own or others' negligence, conditions related to travel, or the condition of the activity location(s). Nonetheless, I assume all related risks, both known or unknown to me, of my participation in this activity, including travel to, from and during this activity.
I agree to indemnify and hold harmless against any and all claims, suits or actions of any kind whatsoever for liability, damages, compensation or otherwise brought by me or anyone on my behalf, including attorney's fees and any related costs, if litigation arises pursuant to any claims made by me or by anyone else acting on my behalf. If PACE MD, MED-Spanish, PACEMD MEXICO A.C.'s, GEMS LLC or the "Site” and/or its agents incurs any of these types of expenses, I agree to reimburse. I acknowledge that and their directors, officers, volunteers, representatives and agents are not responsible for errors, omissions, acts or failures to act of any party or entity conducting a specific event or activity on behalf of PACE MD, MED-Spanish, PACEMD MEXICO A.C.'s, GEMS LLC or the "Site” and/or its agents.
I acknowledge that this activity may involve a test of a person's physical and mental limits and may carry with it the potential for death, serious injury, and property loss. The risks may include, but are not limited to, those caused by terrain, facilities, temperature, weather, lack of hydration, condition of participants, equipment, vehicular traffic and actions of others, including but not limited to, participants, volunteers, spectators, coaches, event officials and event monitors, and/or producers of the event. I acknowledge that I have carefully read this "waiver and release" and fully understand that it is a release of liability.
I expressly agree to release and discharge and all of its affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors and assigns, from any and all claims or causes of action and I agree to voluntarily give up or waive any right that I otherwise have to bring a legal action against for personal injury or property damage. To the extent that statute or case law does not prohibit releases for negligence, this release is also for negligence on the part of, its agents, and employees. In the event that I should require medical care or treatment, I agree to be financially responsible for any costs incurred as a result of such treatment.
I am aware and understand that I should carry my own international (health) insurance. In the event that any damage to equipment or facilities occurs as a result of my or my family's willful actions, neglect or recklessness, I acknowledge and agree to be held liable for any and all costs associated with any actions of neglect or recklessness.
VIDEO FOOTAGE AND STILL PHOTOGRAPHS:
By booking a PACE MD’S MED-Spanish On-line/On-site experience, registrants consent to the following Agreement: ACE MD, MED-Spanish, PACEMD MEXICO A.C.'s, GEMS LLC or the "Site” and/or its agents (“Producer”) may capture video footage and still photographs for academic evidence and/or self-marketing purposes. Your name, likeness, image, voice, appearance, slide or PowerPoint presentation, and/or performance may be recorded and made part of the recording in which you appear (“Product”).
1. Producer or its designees have complete ownership of the Product, including copyright interests.
2. Registrant is providing certain rights to the Producer in connection with the Product, including, but not limited to:
a) Granting to the Producer and others acting on their behalf, a perpetual, irrevocable, royalty-free nonexclusive worldwide license to copy, distribute, modify, display and perform publicly and otherwise use, and authorize others to use, the Product for any educational or commercial purpose throughout the world and in any media, and license others to do the same, including posting or linking to the Product on the Producer’s websites and social media pages and making it available to the general public from its respective websites and social media pages and to distribute it to groups and any other organizations interested in showing it for educational or commercial purposes, including, but not limited to; Internet sites, radio broadcasting, conferences and events, on television, social media and other media outlets; and
b) Without limitation, the right and permission to record, copy, reproduce, adapt, edit, mix or duplicate and use or re-use Product in whole or in parts as Producer may elect.
c) Without limitation, the right and permission to summarize, publish, exhibit, broadcast, distribute and otherwise exploit by any and all uses and media, now known or hereafter devised, throughout the universe.
This grant includes the right to use Product as academic evidence or for promoting, marketing and/or branding. This may be done in whole or in parts, and alone or with other products, for any purpose Producer or its designees determine.
3. Registrant has the right to enter into Agreement and is not restricted by commitments to third parties.
4. Producer has no financial commitment or obligations to Registrant as a result of Agreement.
5. Registrant hereby waives any right to inspect or approve the Product or the use to which such Product may be applied.
6. Registrant releases, discharges, and holds harmless the Producer from and against any and all claims that Registrant may have arising from or in connection with participation in the Product and its related events.
